Terms & Conditions – Music Production Coaching with Dennis Sheperd
1. Ownership & Publishing
- All compositions, ideas, and musical content created by Dennis Sheperd during coaching sessions remain the intellectual property of Dennis Sheperd.
- If a coached composition is commercially released, Dennis Sheperd shall receive a fair publishing share, to be negotiated in good faith based on creative contribution.
2. Scheduling & Cancellations
- Sessions must be cancelled or rescheduled at least 2 hours in advance to avoid penalties.
- Cancellations or rescheduling requests made within 2 hours of the session start time will result in a 100% session fee deduction.
- No-shows without prior notice will be treated as completed sessions and charged in full.
3. Session Format, Conduct & Time Boundaries
- Coaching sessions are held online (unless agreed otherwise) and conducted via video conferencing platforms.
- The client must ensure a stable internet connection and appropriate setup to fully benefit from the session.
- Dennis Sheperd is only available during the booked time slot. Any coaching, feedback, or communication requests outside of the booked time must be scheduled and compensated separately.
- Disruptive behavior or disrespectful communication may result in termination of the session without refund.
4. Recording of Sessions
- Sessions may only be recorded if both parties explicitly agree at the start of the session.
- Any unauthorized recording (audio or video) is strictly prohibited.
5. Payment Terms
- All sessions must be paid in advance to confirm the booking.
- Invoices are issued upon request and must be settled in accordance with the payment terms stated.
6. Confidentiality
- All shared project files, personal information, and creative discussions during coaching sessions are treated as confidential and will not be disclosed to third parties without consent.
7. Liability
- While every effort is made to ensure the effectiveness of coaching sessions, no guarantees are made regarding the commercial success or technical results of coached productions.
- Dennis Sheperd is not liable for any technical failures or damages resulting from third-party software, plugins, or hardware used during the sessions.
8. Force Majeure
- Neither party shall be liable for delays or failures in performance resulting from events beyond their reasonable control, including but not limited to natural disasters, power outages, internet service disruptions, illness, or government restrictions.
- Oversleeping, missed alarms, personal scheduling conflicts, or public transport delays are not considered force majeure and do not exempt the client from cancellation or no-show penalties.
9. Governing Law
- These Terms & Conditions shall be governed by and construed in accordance with the laws of Germany, with jurisdiction in Berlin.
